1. Company Information
Omnidex Testing Solutions LLC is a limited liability company organized under the laws of the State of Maryland. We provide mobile specimen collection and DNA testing services across Maryland's Eastern Shore. These Terms govern your use of our website at and all related services.
2. Eligibility
You must be at least 18 years of age to book services directly. DNA testing involving minors requires the written consent of a parent or legal guardian. By using our services, you represent and warrant that:
- You are at least 18 years old, or are a parent or legal guardian acting on behalf of a minor;
- You have the legal authority to enter into this agreement on behalf of yourself and any participants you register;
- All information you provide is accurate, complete, and current.
3. Services Provided
Omnidex provides mobile specimen collection and DNA testing services including, but not limited to, paternity testing, maternity testing, relationship DNA testing, legal chain-of-custody DNA testing, and peace-of-mind personal testing. We are not a licensed medical provider and our services do not constitute medical advice, diagnosis, or treatment.
All laboratory analysis is performed by independent, accredited third-party laboratories. Omnidex is responsible solely for the specimen collection process and chain-of-custody handling up to the point of laboratory submission.
4. Appointments and Cancellations
Appointments are confirmed upon receipt of your booking submission and our written or electronic confirmation. To cancel or reschedule, please contact us at support@example.com at least 24 hours prior to your scheduled appointment time.
- Cancellations with 24+ hours notice: No cancellation fee applies.
- Cancellations with less than 24 hours notice: A cancellation fee may apply, as communicated at the time of booking.
- No-shows: Clients who do not appear at the scheduled time without prior notice forfeit any pre-paid fees.
Omnidex reserves the right to reschedule or cancel appointments due to weather, emergencies, or circumstances beyond our reasonable control, in accordance with Maryland's force majeure principles under common law.
5. Payment Terms
Payment terms, fees, and accepted payment methods will be communicated to you prior to or at the time of service. All fees are stated in U.S. dollars. By submitting a booking, you agree to pay all applicable fees for the services selected.
In accordance with Maryland's Consumer Protection Act, Md. Code Ann., Com. Law §§ 13-101 et seq., we are committed to transparent pricing. We will not charge undisclosed fees. If a dispute arises regarding fees, please contact us promptly at support@example.com.
6. Informed Consent
By proceeding with a specimen collection appointment, you voluntarily consent to the collection of a biological specimen (typically a buccal/cheek swab) for the purpose of DNA analysis. You acknowledge that:
- You understand the nature and purpose of the test you are requesting;
- You are providing your specimen freely and without coercion;
- For legal DNA tests, all parties have been properly notified and have consented as required by applicable Maryland law;
- Results will be provided only to authorized parties as indicated at booking.
Obtaining a DNA specimen without the knowledge or consent of a participant may violate Maryland law, including Md. Code Ann., Cts. & Jud. Proc. § 10-1302 (prohibiting collection of DNA without consent). Omnidex strictly prohibits any attempt to circumvent consent requirements.
7. Accuracy of Results
DNA testing results are generated by independent accredited laboratories using scientifically validated methodologies. While our laboratory partners maintain high accuracy standards, no DNA test is unconditionally guaranteed. Results are based solely on the specimens submitted and the chain-of-custody procedures followed at collection.
Omnidex is not liable for any errors in results caused by improper specimen handling by participants, contaminated samples, or laboratory processing errors beyond our reasonable control.
8. Legal DNA Testing — Chain of Custody
For legal DNA testing, Omnidex follows strict chain-of-custody protocols as required for court-admissible results. It is your responsibility to inform us at the time of booking that your test requires legal chain-of-custody procedures. Tests booked as personal/peace-of-mind tests are not automatically converted to legal-grade tests.
Omnidex makes no representations as to the admissibility of results in any particular court or jurisdiction. The admissibility of DNA evidence is ultimately determined by the applicable court or agency.
9. Confidentiality of Results
Test results will be released only to the authorized parties designated at the time of booking. Omnidex will not release results to any third party — including law enforcement, employers, or insurance companies — without your explicit written consent or as required by a valid court order, subpoena, or Maryland law.
Our handling of your personal and genetic information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Prohibited Uses
You agree not to use our website or services to:
- Collect DNA specimens from any person without their knowledge and consent;
- Submit fraudulent, misleading, or falsified information;
- Interfere with or disrupt our website, systems, or infrastructure;
- Violate any applicable local, state, or federal law or regulation;
- Engage in any conduct that is harassing, abusive, or harmful to others.
11. Limitation of Liability
To the fullest extent permitted by Maryland law, Omnidex Testing Solutions LLC, its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or website, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim. Some jurisdictions do not allow limitation of liability for certain claims; to the extent such limitations are prohibited by applicable Maryland law, they shall not apply.
12. Indemnification
You agree to indemnify, defend, and hold harmless Omnidex Testing Solutions LLC and its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of our services, or your violation of any applicable law.
13. Disclaimer of Warranties
Our services and website are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, to the fullest extent permitted by Maryland law. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.
Before initiating any legal action, you agree to first contact us at support@example.com and provide a written description of the dispute, giving us 30 days to attempt resolution in good faith.
15. Maryland Consumer Protection
Nothing in these Terms limits or waives any rights you have under the Maryland Consumer Protection Act, Md. Code Ann., Com. Law §§ 13-101 et seq., or any other non-waivable consumer protection statute. If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions will continue in full force and effect.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of our services after such changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
